1. Introduction and Acceptance

Welcome to Viaarctic. These Terms of Use govern your access to and use of the Viaarctic platform, including our website and related services. By accessing or using our platform, you agree to be bound by these terms.

Viaarctic operates as a marketplace connecting travelers with local service providers (guides, transport providers, media services, and accommodation hosts). We facilitate these connections but are not the direct provider of the services.

2. User Accounts

To use certain features of our platform, you must create an account. You agree to:

  • Provide accurate and complete information during registration
  • Keep your account credentials secure and confidential
  • Be responsible for all activities under your account
  • Notify us immediately of any unauthorized account use
  • Not create multiple accounts for fraudulent purposes

3. Service Provider Obligations

If you offer services through Viaarctic, you agree to:

  • Hold all necessary licenses, permits, and certifications required by Norwegian law
  • Maintain appropriate insurance coverage for your services
  • Provide accurate descriptions of your services
  • Honor confirmed bookings and pricing
  • Comply with all applicable local and national laws
  • Meet safety standards and provide safe experiences

4. Liability and Insurance Disclaimer

IMPORTANT: Viaarctic is a platform that connects service providers with customers. We are NOT the provider of tours, transport, media services, or accommodations.

Viaarctic does not provide insurance coverage for damages, injuries, accidents, or losses that may occur during services booked through our platform. Service providers and customers are responsible for their own insurance coverage.

  • Service providers must maintain their own liability insurance as required by Norwegian law
  • Customers are strongly advised to have personal travel insurance covering accidents and injuries
  • For accommodation services, hosts should have appropriate home insurance (innboforsikring)
  • Viaarctic is not liable for any personal injury, property damage, or death occurring during services
  • Any disputes regarding injuries or damages should be resolved directly between the parties involved

5. Assumption of Risk

Many activities offered through Viaarctic involve inherent risks. By booking a service, you acknowledge and accept that:

  • Outdoor activities such as hiking, fishing, and tours carry inherent risks including injury or death
  • You participate in all activities at your own risk
  • You are responsible for assessing whether an activity is suitable for your physical condition
  • Weather and natural conditions may affect services and pose additional risks
  • You should follow all safety instructions provided by service providers

6. Deposit Protection System

For certain services, especially accommodations, a deposit may be required. Our deposit system works as follows:

  • Deposits are held securely by Viaarctic during the service period
  • Service providers may file claims for damages within the specified timeframe
  • Customers have the right to dispute claims and provide evidence
  • Unclaimed deposits are released automatically after the claim period
  • The deposit system is designed to protect both parties but does not replace proper insurance

7. Booking and Cancellation

Bookings made through Viaarctic are subject to the following terms:

  • All bookings are confirmed once payment is processed
  • Cancellation policies vary by service provider and are displayed before booking
  • Refunds are processed according to the applicable cancellation policy
  • The cancellation policy that applies to your booking is the one displayed at the time of booking. Later changes to a provider's policy do not affect existing bookings.
  • Under the Norwegian Right of Withdrawal Act (angrerettloven), the 14 day right of withdrawal does not apply to leisure services booked for a specific date or period. Cancellations are instead governed by the provider's cancellation policy shown at booking.
  • Service providers may cancel bookings in exceptional circumstances
  • Viaarctic charges a platform fee that is non-refundable unless otherwise stated

8. Payments and Fees

All payments are processed securely through our payment provider (Stripe). By using our platform:

  • In addition to the listed price, customers pay a service fee shown at checkout before payment. The service fee is non-refundable, except where the provider cancels the booking or where required by law.
  • Service providers receive payouts minus the ViaArctic platform fee (15%)
  • Provider payouts are released after the service is completed, following a holding period. Payouts may be paused where a booking is disputed.
  • All prices are displayed in the currency specified on the listing. Prices may be displayed in other currencies for convenience. The charge is made in the listing currency (NOK), and the final amount in your own currency depends on your bank's or card issuer's exchange rate and fees.
  • You are responsible for any taxes applicable to your income or purchases

9. Prohibited Conduct

Users of the Viaarctic platform agree not to:

  • Violate any laws or regulations
  • Misrepresent your identity or qualifications
  • Harass, threaten, or harm other users
  • Post false, misleading, or defamatory content
  • Circumvent the platform to avoid fees
  • Use the platform for illegal activities
  • Interfere with the platforms operation or security
  • Post manipulated, fabricated or incentivized reviews

10. Intellectual Property

Only customers with a paid and completed booking may leave a review of that service. Reviews reflect genuine customer experiences, and fabricated or manipulated reviews will be removed.

12. Intellectual Property

The ViaArctic platform, including its design, logos, and content, is protected by intellectual property laws. Users retain ownership of content they upload but grant ViaArctic a license to use such content for platform operations and marketing.

Where providers share content with ViaArctic or tag ViaArctic in content on social media, they grant ViaArctic a non-exclusive right to repost and use that content in ViaArctic's own channels and marketing, with attribution to the provider. Providers may withdraw this permission for future use at any time by contacting us

13. Limitation of Liability

To the maximum extent permitted by Norwegian law:

  • ViaArctic is not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount paid for the specific service in question
  • We are not liable for service provider actions, negligence, or misconduct
  • We are not liable for natural disasters, weather events, or force majeure
  • We are not liable for third-party products or services

14. Dispute Resolution

Service disputes:

  • Users should first attempt to resolve issues directly with each other
  • ViaArctic may offer mediation services at our discretion
  • Unresolved disputes are subject to Norwegian law
  • The courts of Norway have exclusive jurisdiction, without limiting consumers' mandatory rights under applicable consumer protection law

Payment disputes:

  • Payment disputes and chargebacks are handled through our payment provider (Stripe) in accordance with card scheme rules
  • Where a booking is subject to a payment dispute, related provider payouts may be paused until the dispute is resolved
  • Providers agree to supply relevant booking documentation when a payment is disputed

15. Changes to Terms

Service ViaArctic reserves the right to modify these terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the new terms.
